This Acceptable Use Policy forms part of the BerthTime Terms of Service. It applies to everyone who uses the Service under a customer account, through the web application, the API, webhooks, the MCP endpoint or any other interface. Capitalised terms have the meaning given in the Terms of Service.
1. Track only what you have a business reason to track
- Submit references (container numbers, bills of lading, booking numbers) only for shipments in which you, your company or your customers have a legitimate business interest, for example as shipper, consignee, notify party, freight forwarder, broker, carrier or their agent.
- Do not use the Service to harvest, enumerate or guess references in order to monitor third parties' shipments or trade flows.
- If you connect carrier credentials, use only credentials that you are entitled to use and that the carrier allows to be used in this way.
2. Do not resell or republish the data
- You may use tracking data internally and share it with the parties involved in the shipment concerned, in the normal course of your business (for example a forwarder showing its customer where that customer's container is).
- You may not resell, sublicense or redistribute tracking data obtained through the Service as a data feed, database or tracking service to third parties, or use it to build or improve a competing tracking or data product, without our written agreement.
- Keep the source attribution that the Service shows when you display carrier data to others, where practical.
3. Respect the Service and its data sources
- Stay within the rate limits, quotas and Plan limits. Do not try to bypass them, for example by spreading traffic over many accounts, API keys or IP addresses.
- Do not create accounts automatically or in bulk, and do not create multiple Free accounts for one business.
- Do not scrape, crawl or mirror the Service, and do not use it in a way that would cause us to make excessive requests to a carrier or data source (for example by forcing repeated manual refreshes).
- Do not probe, scan or test the security of the Service without our prior written permission. If you find a vulnerability, report it to odoo@majorbird.com and give us reasonable time to fix it before disclosure.
- Do not interfere with or disrupt the Service, other customers, or our providers, and do not upload malware.
- Do not point webhooks or callbacks at systems you are not authorised to use, or use them to attack other systems.
4. Stay within the law
- Do not use the Service for any unlawful, fraudulent or deceptive purpose.
- Comply with export control and sanctions laws, and do not use the Service for or on behalf of sanctioned persons or for prohibited trade.
- Do not submit personal data that you have no lawful basis to share, or sensitive personal data. Shipment references, tags and notes should not normally contain personal data about private individuals.
- Do not infringe the intellectual property or other rights of others.
5. What we do about misuse
We monitor usage at an aggregate level to protect the Service. If we reasonably believe this policy has been breached, we may warn you, throttle or block requests, disable API keys or webhooks, suspend the affected account, or terminate it as described in the Terms of Service. Where possible we will contact you first and give you a chance to fix the problem, unless immediate action is needed to protect the Service, our data sources, other customers or the law.
6. Reporting
To report misuse of the Service, or if you are a carrier or rights holder with a concern about how your data is used in the Service, contact odoo@majorbird.com. We review every report and respond promptly, and where appropriate we will stop or adjust the use of a data source.
